Daryl thought you may be interested in the gritty details of how our first deal came to be, so here you go! You'll note some now obvious newbie mistakes along the way.

We had first been in contact with the HO in January after the NOD on his 2nd published on 12/30. Over the course of the next couple of months he was very difficult to contact, and each time he had failed to take any of the steps we talked about in our previous conversation. Around the beginning of March he called to say he was going to need our help but couldn't talk at the moment, so we set up an appointment for the next day. He promptly went MIA for the next two weeks. We knew he was behind on his 1st but had not seen a NOD on it, so we figured his NOTS from the 2nd wouldn't be filed until mid-March. However, on March 14th the NOTS came up for the 1st going to auction on the 21st (we saw the NOD on the G/G index but thought it was another HO by the same name since there was no NOD on Foreclosures.com! Suddenly we went from having a few weeks to a few days!

Going back to the neighbors I learned that the HO walked to the local liquor store at about the same time every morning. I then left a message with the owner of the liquor store, took a day off of work, and spent two mornings (Friday and Saturday) camped out in front of the HO's condo to catch him on the way to the liquor store. The first day he never showed and the 2nd he went a couple hours earlier than his usual time, so I missed him. Knowing that I had staked out his home twice, left notes on his door and phone, rang the doorbell for 15 minutes straight, left a "take away" note, and had his favorite liquor store give him a message and STILL not gotten a response, I determined it was probably time to focus my time on other HOs. However, it bothered both my wife and I that we just knew in our hearts this HO was going to go to auction and was going to lose his 75% equity. So, on Tuesday - the morning before his auction - I tried his phone one last time when I got into work. Unbelievably, he answered.

How was he doing? "Not good." Why hadn't he responded to me? "Scared and didn't know what to say or do." What had he done? "NOTHING." He asked if I could still help, I told him maybe, and then we met in the early afternoon to sign the contract. When we were done I called the lender to try to get an extension, but they were in Texas and I got the last service rep before she headed out the door for the day. She had me fax over the docs for their review, but no one else was there to talk to, so I had to call back in the morning. In the meantime I went and opened escrow that evening.

On Wednesday, the day of the auction, I got up early and spent 45 minutes on the phone negotiating with the lender. The HO had failed on promises to pay them off, so they would grant no extensions. However, they did agree to accept reinstatement but said I had to figure it out with the trustee before the auction at 2:00 PM that day. The trustee faxed me a reinstatement amount at about 10:30 and said I had to hand deliver a cashier's check to the auctioneer at the court house. They promised to notify the auctioneer and tell him I was coming. I ran to the bank, got the check, and was at the courthouse just before 1:00 PM. When he hadn't shown up by 1:50 PM (they said he should be there 1:30 - 1:45), I called again and got his name and physical description. He appeared as I was hanging up.

I pushed to the front of the crowd that instantly gathered around him and told him that I was there to reinstate the property and that the trustee should have notified him. He was clearly in a bad mood and responded with "I wish they would have." He agreed to look at my check and reinstatement fax, took the check, and then proceeded to start auctioning off two properties without saying anything else to me! Thus, I got back on the phone with the trustee, who put me on hold while they tried to contact him via his agency on his cell phone. After selling the second house he answered his cell and proceeded to discuss the matter while I stood 5 feet away on the other line. Finally, at about 2:25, he cried that the auction for my HO's property had been canceled (to the chagrin of at least 4 auction investors)! I filled out the required paperwork and promptly called one very relieved HO!

Escrow proceeded O.K. until it was determined that a previous private-party lien holder from 12 years prior had never filed a reconveyence, even though the HO had provided a statement showing the lien had been paid off in 2000. Worse yet, no one could find the lender and the escrow company that handled the payoff was no longer in business. So, my wife and I used your skip trace techniques to track him down via neighbors and a couple of relatives. He was irritable, but we sent a notary to his new house and got him to sign the reconveyence. That delayed escrow from 8 to 12 days, but we are finally closed and our HO is walking away with $123,000! Both our escrow officer and our realtors were impressed with the deal our HO got - their comment was that anyone else would have given him "bus money." It felt good to have other real estate professionals express that we did this HO a big favor - thanks for teaching us how!

One other fun detail I forgot - when he pulled out his driver's license for the notary it had expired - NINE years ago! We ended up doing the two witness method.

... I door knocked for the 2nd time a HO who hung up on me the first time I contacted her. This time after a 20 min discussion she offered her hand and said "you're a good soul - don't change your soul." Man does that feel good coming from basically a stranger!
